Terms of Service

1. Brand Ownership & Intellectual Property Rights

All trademarks, logos, brand kits, domain names, and official merchandise designs (including official apparel, headwear, and safety gear) displayed on Moddy Store are the exclusive intellectual property of Moddy Creations.

Clients providing custom logos or artwork for stationery, display banners, or corporate apparel warrant that they hold full legal ownership or authorization for usage. Clients agree to indemnify Moddy Creations against any third-party copyright or trademark claims arising from client-submitted assets.

2. Pre-Production Sign-off & Production Tolerances

To ensure corporate accuracy, a digital proof is generated for client review prior to mass production.

• Proof Sign-off: Mass production commences only after written or digital confirmation of the proof by the client. Moddy Creations is exempt from liability for layout or text errors present in approved proofs.
• Material & Print Tolerances: All paper GSM ratings (80gsm, 100gsm, 350-400gsm), finishes (UV-Spot, Embossed, Laminated), and fabric specs conform to high commercial standards. Minor RGB-to-CMYK color variance is recognized as industry standard.

3. Commercial Quotes, Payment & Order Cancellations

• Quotations: Custom corporate quotations are valid for 30 calendar days from issue date.
• Deposits & Payments: Custom orders require a non-refundable commitment deposit (typically 50%) upon proof sign-off to secure materials, with the balance payable prior to final dispatch.
• Cancellations: Due to the customized nature of corporate printing, orders cannot be canceled once physical production or laser etching has been initiated.

4. Logistics, Regional Transport & Risk Ownership

Moddy Creations coordinates organized regional transport and dispatch across Kenya and East Africa (Uganda, Tanzania, Rwanda).

Risk of loss or damage transfers to the designated courier/logistics partner upon handover at our dispatch center. We actively assist clients with tracking and insurance claims in the event of courier delays or damages.
